Condition of use

  1. Definitions

The following terms have the meaning assigned to them in these General Terms and Conditions of Sale (GTC):
• “À la Française”: À la Française Tourisme SARL, SIREN 523 089 399, whose registered office is located at 3 rue d’Enghien, 33000 Bordeaux, France.
• “Client”: any natural or legal person making a booking with À la Française.
• “Shared Tour”: a small-group excursion operated by À la Française, as described on the website alafrancaise.fr, including transportation by minivan, etc.
• “Private/Bespoke Service”: an exclusive or customized service defined in a quotation sent to the Client.
• “Supplier”: any external provider involved in the delivery of the Tour (transport operator, guide, monument, restaurant, etc.) on behalf of À la Française.
• “Contract”: the booking confirmation or voucher sent by À la Française to the Client after payment, formalizing the agreement between both parties.
• “Program”: the itinerary, schedule, and services described for the Tour or Private Service.
• “Tour/Service Day”: the date on which the Tour or Service is to be performed.

 

  1. Scope of application

These GTC apply to all bookings made via the website alafrancaise.fr or any other channel for Shared Tours or Private/Bespoke Services offered by À la Française.
The Client declares having read and accepted these GTC prior to booking.
Any contrary condition set by the Client shall be unenforceable against À la Française, unless expressly accepted in writing.

 

  1. Prices

Prices are quoted in euros (€), net and inclusive of taxes, and may be changed at any time without prior notice.
Entrance fees, meals, and tastings are included only when expressly stated in the offer.
Any obvious pricing error appearing on the website may be corrected prior to booking confirmation, after informing the Client.

 

  1. Booking Conditions – Shared Tours

4.1. The Tour is confirmed once full payment (100%) of the total amount due has been received, unless otherwise contractually agreed.
4.2. Children under 4 years old are not accepted on Shared Tours. A 20% discount applies to children aged 4 to 11. Adult rates apply from 12 years old.
4.3. The Client must provide, at the time of booking, all necessary information (name, number of participants, age of participants, correct contact details, and any special needs such as disabilities or dietary requirements). The Client agrees to immediately inform À la Française of any change that may affect the organization of the Tour.
4.4. À la Française reserves the right to refuse any booking or cancel the Contract if it deems the request suspicious, or in case of fraud or attempted fraud.

 

  1. Booking Conditions – Private and Bespoke Services

5.1. A deposit of 30% is required upon booking, prior to any service confirmation. For payments under €1,000 by credit card, this method is accepted; beyond that amount, payment must be made by bank transfer.
5.2. All bank charges (credit card or transfer fees) are borne by the Client.
5.3. The balance must be paid no later than 60 days before the scheduled service date. If the booking is made less than 60 days before service, full payment is due at the time of reservation.
5.4. In the event of late payment, À la Française reserves the right to suspend or cancel the service without compensation to the Client.

 

  1. Cancellation Policy – Shared Tours

6.1. For cancellations made at least 24 hours before the tour departure, a full refund will be issued, provided that the cancellation is notified in writing (email or form).
6.2. Cancellations made by the Client due to adverse weather conditions are entirely at the Client’s discretion and will not entitle them to any refund.
6.3. In case of absence or late arrival of the Client without prior written notice, the Tour price remains due in full.

 

  1. Cancellation Policy – Private and Bespoke Services

7.1 Stays

  • More than 90 days before arrival: 10% of total amount non-refundable.
    • Between 90 and 7 days before arrival: 50% non-refundable.
    • Less than 7 days before arrival: 100% non-refundable.
    All cancellation requests must be made in writing.

7.2 Private Tours or Shore Excursions

  • More than 7 days before the tour date: full refund.
    • Less than 7 days before the tour date: no refund.
    A change of date is possible free of charge, subject to availability.

7.3 Weather Cancellations

Cancellation due to weather, or replacement by an alternative program previously agreed upon, remains at the Client’s discretion. No refund shall be claimed on this basis.

 

  1. Service Delivery

8.1. Shared Tours: departures are guaranteed with a minimum of 2 participants. Tours are operated in air-conditioned minivans with 8 passenger seats plus driver. Smoking, eating, or drinking inside the vehicles is strictly prohibited.
8.2. À la Française reserves the right to modify, without prior notice, the program or replace a service by an equivalent one, depending on supplier availability or cancellations. Such modifications shall not entitle the Client to any refund or compensation.
8.3. À la Française may cancel any service without prior notice if weather or any situation presents danger to participants or equipment. In such case, the Client will receive a refund for the cancelled service or portion thereof.
8.4. The Client must respect schedules and meeting points and arrive at least 15 minutes before departure. In case of late arrival, the guide or driver is not obliged to wait, and no refund will be granted.
8.5. À la Française cannot be held responsible for:
• delays due to traffic, strikes, transportation incidents, or causes beyond its control;
• accidents occurring when boarding or alighting from vehicles;
• loss, theft, or damage of personal belongings during the Tour or Service.
8.6. Some Tours may require a certain level of mobility or take place outdoors or in areas with uneven or cobblestone surfaces. Clients with reduced mobility or strollers are requested to contact À la Française prior to booking to assess feasibility.

 

  1. Payment Methods

9.1. The price of the Tour or Private Service is payable upon booking or as described in section 5 (deposit, balance).
9.2. Payments by credit card or bank transfer are accepted. The Client guarantees that they are authorized to use the chosen payment method.
9.3. À la Française reserves the right to refuse any booking or suspend a service in case of suspicious payment, non-payment, or fraud.
9.4. Bank fees related to payments are borne by the Client, as stated in section 5.
9.5. In case of changes in exchange rates, taxes, or legislation resulting in cost increases for À la Française, the company reserves the right to adjust its prices up to the date of payment.

 

  1. Withdrawal Right

In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to Tours and Services booked for a specific date or period, such as guided tours or leisure activities. The Client is expressly informed of this exclusion.

 

  1. Liability & Insurance

11.1. À la Française undertakes its best efforts to deliver the services as described but disclaims all express or implied warranties (including fitness for a particular purpose).
11.2. À la Française shall not be held liable if a Tour or Service cannot be performed, or is modified, due to unforeseeable events or circumstances beyond its control (force majeure, acts of third parties). In such cases, only a rescheduling or refund effort is guaranteed.
11.3. The Client certifies that he has voluntarily and freely elected to participate in the tour, and that he is not required to do so. He understands that participation in the tour involves risks that A la Française cannot eliminate, including, among others, risk of property damage, illness, bodily injury, permanent disability, and death. The Client attests that he is in good health and physically and mentally fit for travel including but not limited to extensive walking over uneven surfaces, climbing stairs at monuments and other locations that are not handicapped accessible, and climbing in and out of various conveyances.
11.4. The Client remains responsible for personal belongings throughout the service. À la Française cannot be held liable for theft, loss, or damage.
11.5. The Client must follow all safety instructions and guidance from the driver/guide and behave appropriately during the Tour. In case of misconduct, À la Française reserves the right to terminate the service without refund.

 

  1. Intellectual Property

All content on alafrancaise.fr (source codes, design, databases, texts, photos, videos, logos) is the exclusive property of À la Française or its partners and is protected by intellectual property law. Any reproduction, modification, or use without written authorization is strictly prohibited.

 

  1. Personal Data

The Client authorizes À la Française to collect, process, and store personal data required for booking and service execution. In compliance with GDPR, the Client has the right to access, rectify, oppose, or delete their data by writing to bonjour@alafrancaise.fr or by post to 3 rue d’Enghien, 33000 Bordeaux, France.
À la Française undertakes to apply appropriate technical and organizational measures to ensure data security.

 

  1. Mediation – Governing Law – Jurisdiction

14.1. These GTC are governed and interpreted in accordance with French law.
14.2. In case of dispute, the Client may request mediation or use the European Online Dispute Resolution platform (ODR): https://ec.europa.eu/consumers/odr/
14.3. Failing an amicable agreement, any dispute concerning the interpretation or execution of these GTC shall fall under the exclusive jurisdiction of the Commercial Court of Bordeaux, where the company’s registered office is located.

 

  1. Assignment – Subcontracting

15.1. À la Française may at any time assign or transfer its rights and obligations under these GTC to another entity.
15.2. The Tour or Service may be subcontracted to a qualified Supplier; however, À la Française remains responsible to the Client for proper contract execution.
